Background Studies have shown that medical students and residents believe that their ethics preparation has been inadequate for handling ethical conflicts. The objective of this study was to determine the self-perceived comfort level of medical students and residents in confronting clinical ethics issues. Methods Clinical medical students and residents at the University of Maryland School of Medicine completed a web-based survey between September 2009 and February 2010. The survey consisted of a demographic section, questions regarding the respondents’ sense of comfort (...) in handling a variety of clinical ethics issues, and a set of knowledge-type questions in ethics. Results Survey respondents included 129 medical students (response rate of 40.7%) and 207 residents (response rate of 52.7%). There were only a few clinical ethics issues with which more than 70% of the respondents felt comfortable in addressing. Only a slight majority (60.8%) felt prepared, in general, to handle clinical situations involving ethics issues, and only 44.1% and 53.2% agreed that medical school and residency training, respectively, helped prepare them to handle such issues. Prior ethics training was not associated with these responses, but there was an association between the level of training (medical students vs residents) and the comfort level with many of the clinical ethics issues. Conclusions Medical educators should include ethics educational methods within the context of real-time exposure to medical ethics dilemmas experienced by physicians-in-training. (shrink)

We present a formal, mathematical model of argument structure and evaluation, taking seriously the procedural and dialogical aspects of argumentation. The model applies proof standards to determine the acceptability of statements on an issue-by-issue basis. The model uses different types of premises (ordinary premises, assumptions and exceptions) and information about the dialectical status of statements (stated, questioned, accepted or rejected) to allow the burden of proof to be allocated to the proponent or the respondent, as appropriate, for each premise separately. Our approach allows the burden of proof for a premise to be assigned to a different party than the one who has the burden of proving the conclusion of the argument, and also to change the burden of proof or applicable proof standard as the dialogue progresses from stage to stage. Useful for modeling legal dialogues, the burden of production and burden of persuasion can be handled separately, with a different responsible party and applicable proof standard for each. Carneades enables critical questions of argumentation schemes to be modeled as additional premises, using premise types to capture the varying effect on the burden of proof of different kinds of questions. The importance of working memory in reading and mathematics performance has been widely studied, with recent research examining the components of WM and their roles in these educational outcomes. However, the differing relationships between these abilities and the foundational skills involved in the development of reading and mathematics have received less attention. Additionally, the separation of verbal, visual and spatial storage and processing and subsequent links with foundational skills and downstream reading and mathematics has not been widely examined. The current (...) study investigated the separate contributions of processing and storage from verbal, visual and spatial tasks to reading and mathematics, whilst considering influences on the underlying skills of verbal comprehension and counting, respectively. Ninety-two children aged 7- to 8-years were assessed. It was found that verbal comprehension was predicted by verbal storage and reading was predicted by verbal and spatial storage. Counting was predicted by visual processing and storage, whilst mathematics was related to verbal and spatial storage. We argue that resources for tasks relying on external representations of stimuli related mainly to storage, and were largely verbal and spatial in nature. When a task required internal representation, there was a draw on visual processing and storage abilities. Findings suggest a possible meaningful separability of types of processing. Further investigation of this could lead to the development of an enhanced WM model, which might better inform interventions and reasonable adjustments for children who struggle with reading and mathematics due to WM deficits. Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.

We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. In the nineteenth century, Henry Sidgwick struggled with the apparent paradox that utilitarians might only attain their goal if they renounced utilitarianism in practice; he also noticed a parallel problem that anticipated what has been called the ‘paradox of desire’ in Buddhist ethics – the paradox that desiring desirelessness is self-defeating. In fact, he regarded only the latter as a genuine paradox. I consider three approaches that might mitigate the problematicimplications for Buddhist ethics and certain forms of consequentialism. One (...) approach draws on recent defences of moral realism that find echoes in at least one Buddhist tradition. The other two draw on what I call the ‘comparative cartography of ethical concepts’; one is due to David Webster, who compares Western andPali-based Buddhist concepts, while the other offers an extension of his approach, comparing ‘thick’ and ‘thin’ ethical concepts, again mainly in the context of ancient Indian Buddhism. I argue that these latter two approaches offer promising defences of Buddhist ethics against objections based on the so-called ‘paradox of desire’. (shrink)

This chapter recounts the rise, eminence, and rapid fall in the philosophical standing of Sir William Hamilton. It sets out the philosophical resources that Hamilton called upon to amend and sustain the ‘common sense’ philosophy of Thomas Reid, responding especially to the criticisms of Thomas Brown. It examines in detail the criticisms that were brought against his philosophy from both sympathizers and opponents. Special attention is given to books on Hamilton published in the nineteenth by Henry Calderwood, Hutchison Stirling, (...) and most notably J. S. Mill’s hugely influential ‘Examination’ of Hamilton. The chapter aims to explain both the high regard in which Hamilton was widely held and the reasons for his speedy relegation to the status of a minor philosopher. This paper explores developments in the defence of theism within Scottish philosophy following Hume's Dialogues and the advent of Darwinian evolutionary biology. By examining the writings of two nineteenth-century Scottish philosophers, it aims to show that far from Darwinian biology completing Hume's destruction of natural theology, it prompted a new direction for the defence of philosophical theism. Henry Calderwood and Andrew Seth Pringle-Pattison occupied, respectively, the Chairs of Moral Philosophy and Logic and Metaphysics at the University of Edinburgh in (...) the late nineteenth century. Their books reveal that the challenge of articulating new grounds for philosophical theism was not motivated by a conservative desire to see off a new intellectual threat, but by a desire for a proper understanding of evolutionary biology. This concluding chapter addresses the conceptual questions that arise in connection with identifying a philosophical tradition, and giving it a distinctive national label. It argues against the common identification of ‘Scottish philosophy’ with the ‘School of Common Sense’, and argues that Francis Hutcheson initiated an approach to philosophical questions that pre-dates the appeal to common sense developed by Reid. It contends that the ‘School of Common Sense’ was just one attempt to formulate a satisfactory response to David Hume. By examining (...) the work of Andrew Seth and Henry Jones, it explores the idea of a shared philosophical agenda, and argues that a common project rooted in a long-standing institutional framework is what sustained the Scottish philosophical intellectual tradition. This paper examines the long dialogue between Africana phenomenology and Africana feminism. In particular, it examines the exchanges between WEB Du Bois, Frantz Fanon, Lewis Gordon and Sylvia Wynter on the one hand, and a number of black feminists on the other, including bell hooks, Natasha Barnes, Farrah Griffin, and Joy James. The primary outcome of the survey of these exchanges is that the pro-feminist spaces created by black male phenomenologists have all been insufficient for the full representation of (...) the black female voice. Published in 1913 as _La Philosophie Bergsonienne_, this incisive critique of the thought of Henri Bergson was Jacques Maritain's first book. In it he shows himself already to have an authoritative grasp of the thought of St. Thomas Aquinas and an uncanny ability to demonstrate its relevance to alternative philosophical systems such as that of Henri Bergson. Volume 1 in the series _The Collected Works of Jacques Maritain_, this edition faithfully reproduces the 1955 translation published by the Philosophical Library. It (...) would be difficult to overestimate Bergson’s role in extricating French philosophy from the deadening materialism that dominated the Sorbonne. It was that cultural milieu that brought Maritain and his wife Raïssa to the brink of suicide. They drew back for two major reasons. First were the lectures of Henri Bergson at the Collège de France, in which the Maritains found a defense of metaphysics, of the transcendent beyond the material, within which they could find meaning in life. The second reason was their conversion to Catholicism, a move they and many of their contemporaries made after being introduced to Bergson’s work. Soon after his conversion, Jacques Maritain immersed himself in the thought of Thomas Aquinas and was struck by the comparative weaknesses of Bergson. This book is Maritain’s relentless criticism of the philosophy of the man whose lectures had meant so much to him. Its ferocity marks it as a young man’s book, written in part to exorcize the defects of Bergson’s philosophy as they were understood by one now schooled in Thomism. Twenty-five years later, Maritain, while not retracting his criticisms, regretted their intemperance and, as a result, moderated his assessment of Bergson in a long preface to the second edition. Gordon Kaufman's theology is characterized by a heightened tension between transcendence, expressed as theocentrism, and immanence, expressed as theological naturalism. The interplay between these two motifs leads to a contradiction between an austerity created by the conjunction of naturalism and theocentrism, on the one hand, and a humanized cosmos which is characterized by a pivotal and unique role for human moral agency, on the other. This paper tracks some of the influences behind Kaufman's program (primarily H. Richard Niebuhr and (...) Henry Nelson Wieman) and then utilizes the flat ontology that emerges in the work of philosopher/sociologist of science Bruno Latour and of environmental philosopher Timothy Morton in order to point toward a reconstructed immanent theocentrism that no longer stakes meaning and value on the unique place of the human. Graham recalls that as an undergraduate studying moral philosophy at St. Andrews in 1968, the only Scottish philosopher he was assigned to read was Hume, whose work was taught in the ahistorical manner that dominated philosophy at that time, and that upon his appointment to the Regius Chair of Moral Philosophy at Aberdeen in 1995 he found little appreciation for the university's most famous former professor, Thomas Reid. Thus began Graham's establishment of the Reid Project at the University of Aberdeen (later the Centre for the Study of Scottish Philosophy and now the Institute for the Study of Scottish Philosophy), the founding of the Journal of Scottish Philosophy, and his editorship of several book series on Scottish philosophy. The story of Graham's scholarship over the years is really the story of the recovery of the history of Scottish philosophy after its near-total neglect in the twentieth century.Graham seems wary of the contextualist turn that historians of philosophy have embraced since around the 1980s, which he likens to "antiquarianism," but at the same time he notes that our current philosophical interests are "not an infallible or even an especially reliable guide to what is intellectually significant" from the past. His solution is to look for intellectual "trajectories" in the history of philosophy—although not with the Whiggish view that these culminate in the present—and to locate particular figures within those trajectories. Thus he is especially interested in identifying the various themes—not just "common sense"— [End Page 551] that can unite the work of different philosophers born and working in Scotland in order to provide a more expansive account of Scottish philosophy.Scottish Philosophy after the Enlightenment provides a close look at the lives and work of major figures of this period, with a chapter devoted to each: William Hamilton (chapter 2), James Frederick Ferrier (chapter 3), Alexander Bain (chapter 4), Thomas Carlyle (chapter 5), Alexander Campbell Fraser (chapter 9), and Andrew Seth Pringle-Pattison (chapter 10). Although Graham argues that Pringle-Pattison's work marks the culmination and end of distinctively Scottish philosophy, he devotes the final chapter to the work of twentieth-century philosopher John McMurray on the grounds that McMurray's conception of human agency is rooted in Scottish debates from the previous two centuries over realism and idealism (chapter 11). Along the way, the book helpfully introduces other thinkers currently much less well known, such as Edward Caird, Henry Calderwood, Henry Jones, James Hutchison Stirling, John Tulloch, and John Veitch.Instead of thinking of Scottish philosophy as simply equivalent to common sense philosophy, Graham offers various alternative conceptions of Scottish philosophy, characterized as various "trajectories" that can be seen as originating in the eighteenth century and developing through the nineteenth: as a concern with realism and idealism that developed in the nineteenth century into responses (whether critical or favorable) to Hegelianism (chapter 6); as a prolonged conversation about the relationship between science and philosophy and the possibility of progress in the scientific study of the mind (chapter 7); and as the continuation of eighteenth-century post-Humean Scottish philosophers' aim of defending theism, even in the face of Darwin's findings (chapters 8 and 9).
